I. General provisions.

  1. The Terms and conditions set out the rules for participation and application for participation in the event called Gdynia Tango Festival taking place from 6th to 8th of September in Gdynia (hereinafter referred to as the “Event”) organized by Fundacja Energia Tanga. Based in Warsaw (hereinafter referred to as the “Organizer”).
  2. A person participating in the Event (hereinafter referred to as “Participant”) is obligated to comply with the provisions of the Regulations.
  3. A consumer is a participant who is a natural person making a legal transaction with an entrepreneur that is not directly related to his/her business or professional activity, professional activity.

 

II. Registration/Contracting.

  1. In order to register for the Event, a registration form made available by the Organizer on the  www.gdyniatango.com must be completed and submitted to the Organizer.
  2. Before registering for the Event, a person interested in participating in the Event is required to read the Terms and Conditions available on the event web page in the content of the registration form.
  3. Completing and sending to the Organizer a properly completed registration form and accepting the participation of the applicant by the Organizer in the
    the manner specified in paragraph 7 below, constitutes the conclusion of an agreement within the meaning of the provisions of the Act of April 23, 1964. – Civil
  4. Code (Journal of Laws of 2020, item 1740, as amended, hereinafter the “Civil Code”).
  5. The Regulations constitute a model contract within the meaning of Article 384 of the Act of April 23, 1964. – Civil Code (Journal of Laws of 2020, item 1740, as amended).
  6. The Organizer shall make the Regulations available free of charge before the conclusion of the Agreement in such a way that a person interested in participating in the Event or a Participant may store and reproduce the template in the ordinary course of activities.
    When filling out the registration form, the person registering is required to provide the data indicated in the registration form. The data will be verified on the day of the event.
  7. A valid email address is required to receive the reservation confirmation. This email will provide information about the next steps to complete the payment for the event.
  8. In case of unavailability of seats at the Event due to exceeding the limit of persons the registration will be suspended. For other reasons such as lack of appropriate proportions between leading and following persons, the registration will be suspended for one of the roles until a balance of roles is achieved.
  9. In order to complete the registration form, the applicant must have the following technical means:
    1) a terminal device with access to the Internet and a web browser;
    2) an active electronic mail (e-mail) account;
    3) cookies enabled.

III. Event Participation Fee

  1. Details of the fees for participation in the Event are indicated in the contents of the registration form.
  2. Payment must be made within 7 days from the day the Participant receives an email from the Organizer confirming acceptance of the Participant’s participation in the Event in accordance with the contents of provision II above.
  3. Payment must be made according to the instructions provided in the confirmation email.
  4. In case of non-payment of the required fee within the above-mentioned time limit, the Organizer has the right to withdraw from the concluded agreement, which is equivalent to inability to participate in the Event.
  5. In case of submitting a declaration of willingness to participate in the Event as a couple, and payment of the fee only for one of the declared persons, the Organizer has the right to refuse participation in the Event to both declared persons, despite payment of the fee by one of them. The paid fee for participation in the Event will be refunded to the designated bank account, within 14 days.

 

IV. Right of withdrawal/cancellation

  1. The agreement concluded between the Participant and the Organizer relates to services related to entertainment events for which the period of service is marked, therefore, based on Article 38 point 12 of the Act of May 30, 2014 on Consumer Rights (j Journal of Laws of 2020, item 287, as amended), the Participant is not entitled to withdraw from the agreement concluded remotely.
  2. Cancellation of participation in the Event is possible only in the case of a change in the person of the Participant. A new Participant may be designated by the Organizer or the resigning Participant. If a new Participant is indicated by the resigning Participant, the new Participant must be accepted by the Organizer. It is not permissible to change the Participant without informing the Organizer.
  3. A notification requesting resignation should be sent by the resigning Participant to the following e-mail address reklamacje@gdyniatango.com. In the content of the e-mail message, one should indicate the identification data of the resigning Participant, the registration data, the bank account number for refunding the paid fees for participation in the Event, possibly the data of the new Participant.
  4. The new Participant is required to complete the registration form in accordance with the provisions of Chapter II .
  5. If the Organizer accepts the substitution of the Participant and the resigning Participant and the new Participant complete all formalities in accordance with these Terms and conditions, the resigning Participant will receive a refund of the paid fees for participation in the Event within 14 days from the date of informing the resigning Participant about the acceptance of the change by the Organizer, to the bank account number indicated by the resigning Participant.

 

V. Rights and obligations and liability of the Organizer and Participants

  1. On the first day of the Participant’s participation in the Event, the Participant will receive from the Organizer an item identifying the Participant (e.g. armband), the presentation of which will be a condition for admission to the Event. The item will be issued after the Organizer verifies the Participant’s data on the basis of a valid identity document.
  2. The Participant is obliged to have the ID badge for the entire period of participation in the Event in a visible place.
  3. The Organizer may refuse entry to the Event to persons:
    1) whose participation in the Event has not been approved by the Organizer;
    2) not in possession of the identifying item referred to in item 1 above;
    3) persons posing a threat including:
    (a) possessing weapons or other objects/materials posing a danger to other persons or property;
    (b) possessing or being under the influence of alcoholic beverages or other intoxicating substances;
    (c) behaving aggressively/unculturally.
  4. Participants are required to behave in a manner that does not threaten the safety of other persons and property.
  5. If the Participant’s behavior leads to damage on the part of the Organizer, the Organizer is entitled to seek compensation from the Participant on general principles.
  6. The Organizer shall be liable to the Participant on general principles.
  7. The Organizer is not responsible for property left by the Participant without supervision and/or adequate security during participation in the Event, with the exception of property left under the supervision of the Organizer in places designated for this purpose.
  8. The Participant taking part in the Event is obliged to comply with the law, including regulations concerning sanitary requirements.
  9. The Organizer shall not be liable to the Participant for failure to perform any of his obligations under the Agreement to the extent that it is caused by the occurrence of Force Majeure. Force Majeure shall mean an external event that is sudden, unforeseeable and beyond the will of the Organizer making it impossible to perform the agreement in whole or in part, permanently or for a certain period of time, which cannot be prevented or counteracted with due diligence of the Organizer including war, epidemic, pandemic, sudden atmospheric event, closure of borders and airports, caused by a state of epidemic in connection with SARS-CoV-2 virus infections.
  10. The Participant is obliged to familiarize himself with the detailed regulations on entry into the country and the rules of movement within the country, the omission on the part of the Participant does not constitute grounds for a refund of the price.

VI. Changes in the organization of the Event.

  1. The Organizer is entitled to cancel the Event.
  2. In case of cancellation of the Event, the Participant is entitled to a refund of the fees paid for participation in the Event less the cost of online payment.
  3. In justified cases, the Organizer is entitled to make changes to the organization of the Event, including changes to the venue, date, subcontractors, changes to the price, in particular in case of:
    1) changes in the applicable laws;
    2) issuance of a ruling by public administration authorities or common courts resulting in the need to make changes;
    3) termination or non-performance of the contract by subcontractors;
  4. If the change concerns a change in the date or venue of the Event,
    Participant is entitled to submit a statement of withdrawal from the contract within 14 days from the date of notification to the Participant of the change in the place or date of the Event. The withdrawal statement should be sent to the email address reklamacje@gdyniatango.com. The above entitlement does not apply to the change of the venue or date of the Event due to the occurrence of force majeure. In the event of withdrawal from the contract, the Participant will receive a refund of the costs paid within 14 days from the date of submission of the statement of withdrawal.

VII. Complaints

  1. The person dealing with the Organizer under the Regulations has the right to file a complaint regarding the services provided by the Organizer in connection with the Event.
  2. Complaints should be sent to the e-mail address reklamacje@gdyniatango.com indicating the identification data of the person making the complaint, registration data and description of the case.
  3. Complaints should be sent no later than 21 days from the date of occurrence of the event giving rise to the complaint.
  4. The Organizer shall respond to the complaint by e-mail to the e-mail address indicated by the complainant within 30 days of receipt.
  5. The Organizer may call on the person filing the complaint to supplement it within a period of no longer than 14 days, with instructions that if it is not supplemented within the specified period, the complaint will be left without consideration. The Organizer will immediately inform the person filing the complaint about exercising the right to leave the complaint unprocessed.

VIII. Out-of-court ways of dealing with complaints and claims.

  1. Within the framework of out-of-court ways of dealing with complaints and claims, the consumer is entitled to turn to, among others:
    (a) a permanent amicable consumer court operating at the Trade Inspection with a request to resolve a dispute arising from the concluded contract.
    (b) the provincial inspector of the Trade Inspection with a request to initiate mediation proceedings for the amicable settlement of the dispute between the Consumer and the Service Provider,
  2. The Consumer may obtain free assistance in resolving a dispute between the Consumer and the Service Provider, also using the free assistance of a district (city) consumer ombudsman or a social organization whose statutory tasks include consumer protection (such as the Federation of Consumers, the Association of Polish Consumers).
  3. Detailed information on the consumer’s ability to use out-of-court procedures for handling complaints and pursuing claims, as well as rules of access to these procedures are available at the offices and websites of county (city) consumer ombudsmen, social organizations whose statutory tasks include consumer protection, Provincial Inspectorates of Commercial Inspection and at the following Internet addresses: https://www.uokik.gov.pl and https://www.rf.gov.pl.
  4. In accordance with the Regulation of the European Parliament and of the Council (EU) No 524/2013 of May 21, 2013 on online dispute resolution for consumer disputes and amending Regulation (EC) No 2006/2004 and Directive 2009/22/EC (Regulation on ODR in consumer disputes), the Organizer as a trader established in the European Union entering into online sales contracts or service contracts provides an electronic link to the ODR (Online Dispute Resolution) platform for out-of-court dispute resolution: https://ec.europa.eu/consumers/odr .

 

IX. Personal data

  1. The administrator of the personal data is Fundacja Energia Tanga based in Warsaw.
  2. Personal data obtained in connection with the registration for the Event and participation in the Event will be processed for the following purposes: handling the registration and participation in the Event and the realization of any claims of the Organizer.
  3. The legal basis for the processing of Customers’ data will be: necessary for the performance of the contract or to take action prior to the conclusion of the contract, necessary for the fulfillment of a legal obligation incumbent on the administrator, necessary for the purposes arising from the legitimate interests pursued by the administrator, such as responding to letters and requests.
  4. The period for which personal data is processed depends on the purpose for which the data is processed. The period for which personal data will be kept is calculated based on the following criteria: legal regulations, the period that is necessary to defend the interests of the Organizer.
  5. Persons providing personal data have the right to: request access to personal data concerning them, correct their data, request completion of
    incomplete personal data, including by submitting an additional statement, to delete their data or limit their processing to object to further processing of their personal data to transfer their personal data.
  6. In case of doubts about the correctness of the processing of personal data, data subjects have the right to lodge a complaint with the supervisory authority.
  7. All correspondence on matters related to the processing of a personal data should be addressed to the e-mail address info@gdyniatango.com

X. Final remarks

  1. The Organizer reserves the right to change this Terms and conditions.
  2. The change of the Terms and conditions comes into force within 7 days from its publication on the Organizer’s website. The Organizer will inform the Participant 7 days before the new Regulations come into force about the change of the Regulations by means of a message sent via e-mail.
  3. Amendments to the Terms and conditions shall not affect activities performed prior to the effective date of such amendments.
  4. The governing law for all legal relations arising from the Regulations is Polish law.
